S&F Lawyers Obtain Jury Trial Victory in Timeshare/MMPA Case

Gary & Ann Halversen v. Branson’s Nantucket Stone County Case No. 15SN-CC00124 (September 2018)

S&F Attorneys Russ Schenewerk and John Spurlock tried Plaintiffs' claims for fraud and violations of the Missouri Merchandising Practices Act ("MMPA") against Branson’s Nantucket, LLC, a timeshare company owned by St. Louis businessman Kevin Knasel. A Stone County Jury of seven men and five women awarded the Plaintiffs $12,000 in actual damages, and the court awarded Plaintiffs their attorneys' fees and costs. Defendant countersued for $112,000 it claimed was due and owing on a promissory note that Plaintiffs signed to purchase the timeshare, and the jury rejected that claim. The jury also found that Defendant misrepresented the timeshare product to Plaintiffs.
